China's E-commerce Industry Intellectual Property Protection Has Been Strengthened comprehensively

The "Research Report on the Development of Intellectual Property in China's Electronic Commerce (2020)" released by the Intellectual Property Development Research Center of China National Intellectual Property Administration on December 28 shows that in 2020, the protection of intellectual property rights in China’s e-commerce industry has been comprehensively strengthened and the results have been remarkable.

According to the statistics from the National Bureau of Statistics, from January to October this year, the national online retail sales reached 9,127.5 billion yuan, a year-on-year increase of 10.9%. Among them, the online retail sales of physical commodities were 7561.9 billion yuan, accounted for 24.2% of the total retail sales of consumer goods. Strengthening the protection of intellectual property rights in the field of e-commerce is of great significance to protecting the legitimate rights and interests of right holders and creating a well business environment.

The report pointed out that each of the e-commerce platform enterprises has fulfilled its platform obligations and refined the management of intellectual property protection within the platform. The number of intellectual property rights holders settled in major e-commerce platforms has been increased. The social co-governance of multiple social entities such as government-enterprise cooperation and rights holder cooperation plays an increasingly important role in protecting e-commerce intellectual property rights.

The report shows that China's major Internet platforms continued to strengthen intellectual property rights protection, and the technology prevention and control system is continuously upgraded. For example, JD’s "REDNET.cn" can provide targeted protection for well-known brands and special trade names, and has protected more than 2,100 well-known brands; the Byte-Dance’s "Lingshi System" can automatically compare the copyrights of videos on the platform through technical means, and quickly figure out infringing content.

Confronting with the global challenge of intellectual property protection in cross-border e-commerce, the report calls on each of the countries to actively develop cooperation regarding international rules coordination, international law enforcement cooperation, cross-border protection services and innovative dispute resolution, and to jointly discuss intellectual property-related protection rules to ensure cross-border protection of E-commerce transactions going on smoothly, and intellectual property protection is effective.
